Apple's standard terms apply

Your use of the Cubby app is governed by Apple's Licensed Application End User License Agreement (the Standard EULA). The terms on this page add to it. By downloading or using Cubby you agree to both. If anything here conflicts with the Standard EULA, the Standard EULA wins.

"Cubby", "we" and "us" mean the independent developer who makes the app. How we handle your data is described in the privacy policy.

What Cubby is

Cubby is an iPhone app that blocks apps you choose during a nightly window you set, gives you small goals for the evening, and tells you in the morning how the night went.

Blocking uses Apple's Screen Time and can only do what Screen Time allows. It is best effort. It can stop working after an iOS update, when Screen Time access is removed, or when your phone's clock or settings change, and you can turn it off at any time by removing Cubby's Screen Time access in iPhone Settings. Cubby is a tool, not a guarantee.

What Cubby is not

Cubby is not medical advice. It does not diagnose, treat or prevent insomnia or any other sleep disorder or health condition, and its morning results are not a medical measurement. If you have trouble sleeping, talk to a doctor.

Do not rely on Cubby to keep you away from, or let you into, anything important. Keep apps you may need at night, such as ones for your health, safety or work, off your blocked list.

Your account

You need an account to use Cubby, and you must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian's permission.

Give accurate sign-in details and keep your sign-in secure. You are responsible for what happens under your account. You can delete your account at any time in Settings → Delete account; the privacy policy says what that removes.

Subscription and billing

Cubby needs a Cubby Plus subscription, billed monthly or yearly. Prices are shown in your currency in the app and on the App Store before you subscribe, and may vary by country.

Payment is charged to your Apple Account when you confirm the purchase. Your subscription renews automatically at the end of each period, at the then current price, unless you cancel at least 24 hours before the period ends. Your Apple Account is charged for the renewal within the 24 hours before the period ends.

The yearly plan may start with a free trial if you are eligible, which Apple decides. Unless you cancel at least 24 hours before the trial ends, it turns into a paid yearly subscription. If you buy a subscription during a trial, any unused part of the trial ends.

Manage or cancel your subscription in iPhone Settings → your name → Subscriptions, or from Cubby's Settings → Subscription. We cannot cancel it for you. After you cancel, you keep access until the end of the period you have paid for. Deleting the app or your account does not cancel your subscription.

Apple handles all payments and refunds. To ask for a refund, go to reportaproblem.apple.com. If a price changes, Apple tells you before it applies to your subscription.

Using Cubby

Use Cubby for yourself and within the law. Do not try to break, overload or get around Cubby or its servers, read other people's data, copy, resell or reverse engineer the app except where the law allows it, or use Cubby to control someone else's phone without their agreement.

What you write in Cubby, such as goals and journal entries, stays yours. You let us store and process it only to run Cubby for you. The app, its name, the bear and the rest of its art and design belong to us.

Ending the service

You can stop using Cubby and delete your account at any time.

We can suspend or close an account that breaks these terms or puts Cubby or other people at risk. We can change Cubby or stop offering it. If we stop it, we will tell you in the app ahead of time where we can. Refunds for any unused time are handled by Apple.

Disclaimers

To the extent the law allows, Cubby is provided as is and as available, without warranties of any kind, express or implied, including that it will be uninterrupted, error free, or will block every app every time.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost sleep, missed alarms, missed messages, lost data or anything else that follows from an app being blocked or not blocked. Our total liability to you for any claim about Cubby is limited to what you paid for Cubby in the 12 months before the claim.

Nothing in these terms limits rights you have as a consumer that the law does not allow to be limited, or liability that cannot be limited by law.

Changes

If these terms change in a way that matters, Cubby will tell you in the app before the change takes effect. The date at the top is the last time they changed. If you keep using Cubby after a change takes effect, the new terms apply.
